The refusal and revocation of a residence permit

The residence permit may be refused or revoked if the foreign applicant is considered dangerous to the public order and security of the Italian state or of one of the countries with which Italy has signed agreements for the abolition of internal border controls and the free movement of persons Regarding the refusal or revocation of the residence permit for family reasons any convictions for certain offenses under the Code of Criminal Procedure are also taken into account. The same permit is also revoked if it is established that the marriage or adoption took place for the exclusive purpose of allowing the person to reside in the territory of the state. Finally, the residence permit cannot be renewed or extended when it appears that the foreigner has interrupted his or her stay in Italy for a continuous period of more than six months or, for two-year residence permits, for a continuous period of more than half the period of validity of the residence permit, unless the interruption was due to serious and proven reasons. The EU residence permit for long-term residents may be revoked if:

• Has been acquired fraudulently: the applicant foreigner has then provided false documents or false statements aimed at obtaining a long-term residence permit without being entitled to it or where the permit has been acquired through the celebration of a marriage of convenience;
• In case of deportation: as regulated by the Consolidated Text on Immigration;
• Lack of or failure to meet the conditions for release;
• The alien is missing from the territory of the state for a period of more than 6 years.
• In case of absence from the Italian territory for a period of at least twelve consecutive months;
• Be granted a long-term residence permit by another European Union member state, after notification by the latter.

  If the EU permit is revoked due to the last two reasons listed, the foreigner is given the opportunity to reacquire it, again subject to verification of the requirements for issuance. In other cases, except for expulsion, the foreigner is issued a non-EU residence permit following revocation.
